Terms of Service

1. Agreement to Terms

By accessing or using Acerola Studio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Acerola Studio is a software-as-a-service (SaaS) platform that enables service professionals ("Business Users") to manage bookings, customers, and availability. Customers of Business Users ("End Users") can book appointments through the platform.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not share your account or allow others to access it
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Business User Responsibilities

As a Business User, you agree to:

  • Legal Compliance: Comply with all applicable laws and regulations in your jurisdiction, including but not limited to:
    • Business registration and licensing requirements
    • Tax obligations (income tax, VAT, etc.)
    • Employment and labor laws
    • Consumer protection laws
    • Data protection regulations (GDPR)
  • Accurate Information: Provide accurate information about your services, pricing, and availability
  • Professional Conduct: Deliver services professionally and as described
  • Customer Data: Handle customer data responsibly and in compliance with privacy laws
  • No Prohibited Activities: Not use the Service for any illegal, fraudulent, or harmful purposes

5. Subscription and Payment

  • Business Users pay a monthly subscription fee to access the Service
  • A free trial period may be offered for new users
  • Payments are processed securely through Stripe
  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time through your account settings or Stripe portal
  • No refunds are provided for partial months or unused service
  • We reserve the right to change pricing with 30 days notice

6. End User Terms

As an End User booking services through the platform:

  • You agree to provide accurate contact information
  • You agree to honor your bookings or cancel/reschedule within the required notice period
  • Payment for services is between you and the Business User - Acerola Studio does not process service payments
  • Disputes about services should be resolved directly with the Business User

7. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Acerola Studio and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. User Content

You retain ownership of content you upload (images, descriptions, etc.). By uploading content, you grant us a license to use, store, and display it as necessary to provide the Service. You are responsible for ensuring you have the rights to any content you upload.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY BUSINESS USERS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACEROLA STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

Business Users agree to indemnify and hold harmless Acerola Studio from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws
  • Services you provide to your customers
  • Disputes between you and your customers

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Sweden.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
